ASSUMPTION OF RISK, WAIVER OF LIABILITY, and INDEMNIFICATION AGREEMENT and PRIVACY CONSENT & PRIVACY POLICY

GENERAL TERMS.

I understand and agree with the following:

  1. That there is some risk in attending and participating in activities at or hosted by Stagwell Global LLC (and together with its affiliates, “Stagwell”) related to Stagwell’s “SportBeach,” between June 15 and June 20, 2025.

  2. That I am voluntarily participating in Sport Beach and I accept all of the risks associated with such participation.Accordingly, I hereby waive and release Stagwell and its employees, its contractors, its insurers, officers, directors, all event sponsors and their representatives (collectively, the “Indemnitees”) from all claims as well as any losses, demands and damages (collectively, “Damages”) resulting from my attendance at and/or participation in Sport Beach. Notwithstanding the foregoing, if it is finally determined that Stagwell does have any liability resulting from my attendance at Sport Beach, I understand that Stagwell’s aggregate liability to me for any Damages will not exceed $100. The limitations in this section shall not apply to Damages caused by the gross negligence or intentional misconduct of Stagwell.I expressly agree to indemnify and hold the Indemnities harmless against any and all Damages that result from my acts or omissions while participating in Sport Beach.

  3. That the Indemnities are not responsible or accept responsibility for any property that is lost, stolen, or damaged while in, on, or about the premises of Sport Beach.
  4. I agree to abide by any decision of a Stagwell employee relative to any aspect of my participation in these activities, including the right of any official to deny or suspend my participation for any reason.
  5. That the foregoing waiver and assumption of risks agreement is intended to be as broad and inclusive as is permitted by the law of the State of New York, and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

CONSENT TO USE MY IMAGE

I expressly consent to Stagwell using my image, whether via photographs, motion pictures, recordings or any other record of my participation in SportsBeach in any medium for any legitimate purposes, including, but not limited to, promotional content regarding Sport Beach or other material produced by Stagwell regarding Sport Beach. My consent also includes the use of my image by authorized partners of Stagwell. Such consent is made without any compensation other than my participation in Sport Beach. Such consent shall be for a reasonable time period of not more than three years from June 20, 2025.

This consent shall be governed by, and construed in accordance with, the laws of New York, United States and the courts of New York shall have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these terms and conditions.

USE OF DATA WE COLLECT

Stagwell is the “Controller” of the Personal Data you supply to Stagwell. Personal Data includes, but is not limited to your name, email address, title and company as well as your location within the SportBeach venue (via a FRID tag in your SportBeach tag).

Stagwell may and you authorize Stagwell to use your personal information for the following purposes:

  • Marketing.
  • Communicating Stagwell activities and news.
  • Sharing with third-parties (including but not limited to SportBeach sponsors and partners) for marketing purposes.

You further authorize Stagwell to share your Personal Data with third party software providers who collect, store and process your personal data on behalf of the Stagwell and who are contractually obligated to keep your personal data confidential subject to appropriate safeguards to prevent it from unauthorized disclosure.

If your personal data is collected in European Union, your personal data will be transferred out of the European Union to Stagwell located in the United States.

Stagwell will store your Personal Data in accordance with the record retention requirements applicable to U.S. laws. Under the EUGDPR, you have the right to request access to, rectify, erase and restrict the processing of your personal data. You also have the right to revoke this consent to use your personal data. If you feel Stagwell has violated the EUGDPR, you have the right to file a complaint with the appropriate EU supervisory authority.
